If you decide to buy an apartment or a house on the coast of Bulgaria, to have a family vacation in the summer or to move permanently to this sunny country, it is important to know how the buying process takes place.
The procedure for buying property in Bulgaria consists of several stages.
• Acquaintance with real estate offers on our website.
First of all, you need to consider the real estate offers presented on our website. • Selection of real estate and making a deposit. When you have looked at all the objects you are interested in and have made your choice, you can make a deposit for the option you like. The standard deposit is 2000 Euro and is subsequently deducted from the cost of the apartment. The deposit can be paid in Bulgaria in person or by transfer in case of remote purchase of real estate. The deposit is valid for about 1 month and during this time the apartment is not offered to anyone else.
• Opening an account. The transaction of purchase and sale of real estate in Bulgaria is carried out through a bank account. Already at the stage of searching for a property, you can start the procedure for registering an account in one of the Bulgarian banks. When carrying out this operation, a foreigner may be asked for documents such as a tax registration number in his native country, a residence address, and so on. To bypass this procedure, some foreigners prefer to transfer money to the seller's account immediately from their account in their home country.
• Drawing up a preliminary contract of sale. The preliminary contract is concluded in a simple written form, the parties may be adults, individuals or legal entities. The contract must contain a description of the property and its price. The parties may additionally agree on the term for concluding the final contract, the method of payment, as well as other obligations. It is important that everything be described precisely and clearly - what the parties agree on and what they want to achieve.
As in any contract, the main elements here are the rights and obligations of the parties. The obligation is to conclude the final contract, and the right to demand the fulfillment of this obligation. It also establishes the term for the sale of real estate.
• Payment for the purchase and sale of real estate occurs on the basis of a preliminary contract.
• Notarial re-registration of real estate occurs after full payment at the notary at the location of the property in the presence of an interpreter. No special documents are required from the buyer at this stage. As a rule, they are asked to provide only a foreign passport as an identity card. But the seller needs a whole package of official papers. This is:
• a certificate that the property has no encumbrances (for example, a loan);
• a document confirming the absence of tax debts;
• property valuation;
• certificate from the cadastre;
• act of the seller, certified by a notary;
• certificate of marital status of the seller.
It is very important to know that when re-registering a property, the buyer will have additional costs, in addition to the cost of the property. These expenses include notarial fees, a one-time tax on the purchase of real estate, etc. On average, all these expenses amount to about 4-5% of the cost of an apartment.
• Registration of ownership. The last legal stage, and in principle the last stage of the procedure for buying property in Bulgaria, is the registration of ownership. That is - obtaining official papers and recognition at the legislative level that the property already belongs to the new owner.
After signing the contract of sale / notarial deed /, the notary must submit it for registration to the district court. Real estate is registered with the Statistical Office of Bulgaria, as well as with the tax office. This whole procedure takes about two months, after which the foreigner becomes the full owner of the property in Bulgaria.
• Support after the transaction. The lawyer accompanies clients at all stages of the transaction, as well as after the re-registration of property. In particular, he is engaged in the registration of a new owner in the Bulstat register, in the tax service, re-registration of water and electricity meters for a new owner.
